Shop4websites will not commence any work on behalf of the Client until it has received the agreed 20% deposit. Where Shop4websites commissions or produces original photography or illustrations they retain the ownership of copyright unless otherwise negotiated.
All material including content and images that have been supplied by the Client and used in the commissioned project will remain the Client's property. By supplying this material to Shop4websites it is assumed that usage is permitted and copyright law is not infringed.
Shop4websites will not make any website live until all payment owing has been received.
If during the course of a project if the Client wishes to cancel, Shop4websites reserves the right to retain the deposit. If additional features were commissioned and work has begun on these, then Shop4websites reserves the right to invoice an amount, comparable to the work carried out to that date.
If any changes are made to copy or images once a site has been agreed, Shop4websites reserves the right to charge for the extra work incurred at the rate described in the Additional Features list.
Prices for the non-fixed price additional features provided are valid for 30 days from date of the quote and payment is due as soon as the completed site is approved. Shop4websites reserves the right to delay launch of site until all monies from the Client have cleared.
If the Client does not use Shop4websites hosting they will receive a zip file for their site to give to their hosting company to upload onto the hosting company's server. Shop4websites has no responsibility to ensure this uploading takes place successfully nor is it responsible for any delays or errors caused in the course of uploading. Shop4websites is responsible for ensuring the zip file is sent promptly to the Client on receipt of all monies owing to Shop4websites. The sum owing shall be less the Shop4websites hosting fee.
The final site is checked by up to two members of Shop4website before uploading to the login area for the Client to undertake final checking and approval. Every effort is made to spot mistakes but the main responsibility for proofing and approval lies with the Client. Clients are asked to send a proof approval email before the website goes live.
Shop4websites reserves the right to utilise any of the designs produced for the purposes of promotional advertising of Shop4websites.
Shop4websites reserves the right to re-quote for any work that extends, varies or falls outside of the original project.
Shop4websites is not liable for any damages or expenses incurred by the Client in the use of the work provided.
These conditions and all other express terms of contract shall be governed and construed in accordance with the laws of England.
SHOP4WEBSITES shall not be responsible for any failure to perform its obligations here under due to circumstances beyond its control.
